Following the recent Firestone tire recall case, on November 1, 2000, Clinton signed into law the Transportation Recall Enhancement Accountability and Documentation (TREAD) Act.  Notwithstanding the acronym, however, the Act applies to all facets of the automobile, automobile equipment, and other manufacturing industries (i.e., AmCham Korea members and OEM component manufacturers alike).  As for motor vehicles and equipment in foreign countries that are identical or substantially similar to those offered for sale in the United States, manufacturers must notify within 5 days of a decision, or a foreign government order, to conduct a safety recall or other campaign in a foreign country.

There are several other areas addressed in the TREAD Act including prescribed legislative follow-up by certain dates, civil and criminal penalties and other details to be developed by NHTSA.

The Korean Product Liability Law was also enacted at the end of 2000, and is going to be enforced as of July 2002. Affecting all the manufacturing industries and importers as well, this law is expected to change nearly every aspect of doing business in Korea. At this point, it is important to understand the difference between the US and Korean PL, if any, and to dispel any possible groundless worries that this enactment
might be nothing but additional trade regulations and burdens.
